PROCEDURE of customs formalities of the goods moved across the customs frontier by the bodies rendering courier mail services on the territory of Turkmenistan

Procedure of customs formalities of the goods moved across the customs frontier by the bodies rendering courier mail services  on the territory of Turkmenistan

I. General provisions

1.  The Procedure of customs formalities of the goods moved across the customs frontier by the bodies rendering courier mail services on the territory of Turkmenistan (hereinafter – the Procedure) is elaborated in accordance with the Customs and Air Codes of Turkmenistan, Laws of Turkmenistan “On communications”, “On licensing of certain types of activities”, the Procedure for implementation of customs control over the international postal shipments, moved across the customs frontier of Turkmenistan, approved by the decree of the Chairman of the State Customs Service of Turkmenistan № 204 dd. March 31, 2012, registered at the Ministry of Justice (Adalat) of Turkmenistan under  the registration number 640 dd. April 16, 2012, and Postal regulations of Turkmenistan, approved by the decree of the Minister of Communications of Turkmenistan №13 dd. January 21, 2016, registered at the Ministry of Justice (Adalat) of Turkmenistan under the registration number 956 dd. February, 12, 2016, and which regulates the procedure of the mutually coordinated actions of the customs body, the mail service enterprise and the cargo terminal in the course of customs formalities of the goods transported by means of aircrafts of international air network communication through the customs frontier of Turkmenistan by the bodies rendering courier mail services on the territory of Turkmenistan.
2. Provisions of the present Procedure shall apply to the goods conforming to the international standards of  the postal shipments, moved across the customs frontier of Turkmenistan on the basis of the contracts concluded with the international courier companies (UPS - United Parcel Service, DHL, FedEx Corporation and etc.), by the bodies rendering courier mail services against the customers’ order on the territory of Turkmenistan, authorized by the Ministry of Communications of Turkmenistan to receive, process, store, transport and deliver (hand over) the postal shipments (hereinafter– the mail service operator).
    The International postal shipments include the following: 
    1) letters (simple, registered, with declared value);
    2) postcards (simple, registered);
    3) letter packets and “М” special bags (simple, registered);
    4) secogrammes (simple, registered), aerogrammes;
    5) small packages (registered);
    6) parcels (simple, with declared value).

3. Terms used for the purpose of implementation of the present Procedure:
air waybill- an international shipping document, conforming to the standards of the International Air Transport Association (Resolution 600А); 
customs body - a customs post, implementing customs control and customs formalities of the international postal shipments and cargoes, moved across the customs frontier, operating at the cargo terminals of the international airports of Turkmenistan;
international mail exchange point - a point, specially designated at the cargo terminal territory of the international airports of “Turkmenhovayollary” Service, for implementation of customs inspection and customs examination of the international postal shipments;
customer -  an individual or a legal entity, receiving or sending the international postal shipments, moved across the customs frontier, using services of the mail service operator;
mail service enterprise - a sorting center of the State Mail Service Company “Turkmenpochta” of the Ministry of Communications of Turkmenistan, located at the international mail exchange point of the international airports, which performs the processing of the international postal shipments, incoming from abroad for further delivery to the destination address and the processing of the international postal shipments, outgoing from Turkmenistan  by air transport;
postal waybill (document) - a postal waybill (document), conforming to the requirements of the Universal Postal Convention and Postal regulations approved by the decree of the Ministry of Communications of Turkmenistan № 13 dd. January 21, 2016, registered at the Ministry of Justice (Adalat) of Turkmenistan under the registration number 956 dd. February 12, 2016; 
    cargo terminal – a cargo complex of “Turkmenhovayollary” Service airport, performing the handling of cargoes and the international postal shipments, transported by foreign and Turkmen air companies.
4. A Master Air Waybill or a postal waybill shall be used for the international postal shipments as a shipping document. These documents regulate relations between the participants of the international postal shipments: freight carrier, consignor and consignee, and confirm the existence of the contract, granting the right for transportation of the international postal shipments by means of  air transport. 
5. By arranging the transportation of the international postal shipments and (or) goods by the international courier services and (or) their authorized operators, a House Air Waybill shall be issued additionally as a shipping document, the reference number (first 3-digit number (prefix) and serial number) of which is to be assigned by the international courier service. The international courier service or its authorized operator is considered as the consignor and/or the consignee of the transported international postal shipment.
6. Shipping documents or any other documents, confirming the observance of restrictions in relation to the goods, transported in the international postal shipments, shall be submitted by the interested party or by the appointed mail service operator to the customs body at the international mail exchange point or in other places, determined by the customs body during the process of customs declaration and cargo customs release.
7. Provisions of the present Procedure do not apply to the goods, moved across the frontier by the mail service operator against the customers’ order on the territory of Turkmenistan in case if the goods do not conform to the standards of the international postal shipments. 
8. The mail service enterprise shall provide a written notification to the customs body and the cargo terminal about the mail service operator, authorized to render courier services on the territory of Turkmenistan not later than 5 (five) business days from the date of respective license issue. 

II. Mutually coordinated actions between the customs body, the mail service enterprise and the cargo terminal in regards to the international postal shipments imported to the customs territory of Turkmenistan

9. The international postal shipments duly completed and delivered by any air companies to the customs territory of Turkmenistan, shall be sorted by the cargo terminal employee in accordance with the air waybill after discharging from the aircraft and handed over to the mail service enterprise. 
10. Before the international postal shipments are handed over to the mail service enterprise, the goods shall be registered in the registration book as per the air waybill by the cargo terminal representative and the appropriate notes in the air waybill shall be made and authenticated by the personal stamp of the customs body officer. 

11. The customs control of the international postal shipments, imported to the customs territory of Turkmenistan shall be carried out in the international mail exchange point. Employees of the mail service enterprise shall submit the international postal shipments, the postal and accompanying documents to the customs body officer for customs inspection and customs examination. 
12. Upon completion of customs examination, the international postal shipments shall be handed over to the mail service operator to the address, indicated on packages of the international postal shipments or in the accompanying documents. 
13. The delivery of the international postal shipments shall be performed by the mail service operator for consignees located in the region of its activity. The delivery of the international postal shipments shall be performed only upon payment of all customs duties and taxes, if any. 

III. Mutually coordinated actions between the customs body, the mail service enterprise and the cargo terminal in regards to the international postal shipments exported from the customs territory of Turkmenistan

14. The mail service operator shall deliver the international postal shipments, subject to export from the territory of Turkmenistan, to the mail service enterprise. The international postal shipments must be properly packed and accompanied with the documents completed as per the established form.  
15. The customs control of the international postal shipments transported outside the customs territory of Turkmenistan shall be performed by the customs body in the activity region of which the international mail exchange point is located.   
16. Employees of the mail service enterprise shall unpack the international postal shipments, exported outside the customs territory of Turkmenistan for customs inspection and customs examination performed by the customs body officer and on the basis of results shall make an act as per the established form. In order to verify the authenticity of documents and data provided, as well as to verify the accuracy of document completion, the customs body officer shall check the provided information and accompanying documents related to the international postal shipments. 
17. At the international mail exchange point, customs control group shall perform customs inspection and customs examination of the international postal shipments in order to check the compliance of information provided in the documents with the goods actually transported in the international postal shipments, and for the assurance of existence of documents confirming the observance of the established limitations and for detection of the goods prohibited for export from the customs territory of Turkmenistan. 
18. Upon the completion of the customs control of the international postal shipments, the customs body officer, after making a decision on releasing the goods, shall put the appropriate stamps on the accompanying documents of the international postal shipment and authenticate them by signature and individual number seal. One copy of documents shall be left at the Customs body, and the rest copies shall be handed over to the mail service enterprise employees.
19. Upon completion of the customs formalities of the international postal shipments, upon agreement with the cargo terminal, the mail service enterprise shall hand over the international postal shipments and accompanying documents to the cargo terminal official for the loading onto the aircraft. 
20. The mail service operator shall submit to the customs body the air waybills and accompanying documents to perform customs formalities of the international postal shipments, which are hold under the temporary storage at the mail service enterprise and subject to be returned to the consignor due to the imposed prohibitions and restrictions established by legislation of Turkmenistan, and due to rejection of goods acceptance by the Consignee. After completion of customs procedures performed by the customs control joint group of customs authorities, the mail service enterprise official under the customs control shall hand over the international postal shipments and accompanying documents to the cargo terminal official for further loading onto the aircraft.  

IV. Final provisions

21. Customs control and customs clearance of international mailings are carried out in accordance with the Procedure for customs control of international shipments moving across the customs border of Turkmenistan, approved by order of the Chairman of the State Customs Service of Turkmenistan No. 204 dated March 31, 2012, registered with the Ministry of Adalat of Turkmenistan under the registration number 640 of April 16, 2012, by the Postal Rules of Turkmenistan, approved by order of the Minister of Communications of Turkmenistan on No. 13 dated January 21, 2016, registered with the Ministry of Adalat of Turkmenistan under registration number 956 dated April 12, 2016.
22. Employees of the customs authority, postal service and freight terminal are responsible for the implementation of this Procedure.
23. The postal operator must submit to the customs authority a monthly report in electronic form, including information on international mailings imported into the customs territory of Turkmenistan, as well as exported outside of it, indicating the date, country of origin and destination, the sender, the recipient, name, quantity (weight), cost, information about the air waybill or postal invoice.
24. Other rules for carrying out customs control of international postal items transported across the customs border of Turkmenistan upon the request of customers, not provided for in this Procedure, shall be regulated in accordance with other applicable laws and regulations of Turkmenistan.
